In the same way that musicians writers and artists control who can reproduce their work, photographers control who can reproduce their images. Authors of original works own the copyright in their work and this is enshrined in legislation - the Copyright Designs & Patents Act 1988.

Don Tonge Photographer holds the copyright of all images taken ( unless otherwise agreed in writing ) on any photographs used on the Don Tonge Photographer website also on any commissioned work and work submitted on speculative basis to publications, agencies and media outlets for worldwide distribution anywhere at anytime.

When work is commissioned, the client will have a usage licence for a minimum of one year ( extended if agreed with the photographer ) to publish the images for their advertising, website, literature, magazine and press release purposes, images must not be sold on or given away without written permission of Don Tonge Photographer. Usage Licence starts on the date on which the client receives the images.

The Client will be authorised to publish the Photographs, within the term of the usage licence, to the exclusion of all other persons. However, Don Tonge Photographer retains the right in all cases to use the Photographs in any manner at any time for purposes of promoting his work. After the exclusivity period of one year ( indicated in the Usage License ) Don Tonge Photographer shall be entitled to use the Photographs for any purposes.

Invoices must be paid within a period of 30 days from the invoice date.
